If you\u2019re starting a <a href=\"https:\/\/www.movoto.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">property search<\/a> and are worried about being treated unfairly because of your <\/span><a href=\"https:\/\/www.movoto.com\/blog\/diverse-michigan\/?fb_comment_id=826294687387684_118316655\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">race, gender, or religion<\/span><\/a><span style=\"font-weight: 400\">, you should know about how federal fair housing laws protect you.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">What is the Fair Housing Act?<\/span><\/h2>\n<p><span style=\"font-weight: 400\">As part of the Civil Rights Act signed by President Lyndon B. Johnson in 1968, the federal government enacted the Fair Housing Act (FHA), prohibiting discrimination in the sale, rental, and financing of housing based on race, religion, and national origin. In 1974, it was amended to include sex, and in 1988, to include people with disabilities, families with children, and pregnant women. In these instances, the FHA enables those who believe they were discriminated against to seek restitution via federal or state courts.\u00a0<\/span><br \/>\n<span style=\"font-weight: 400\">Discrimination or unfair treatment aren\u2019t the only things that are covered. The FHA also makes it a federal crime for a home seller or landlord to use force or threat of force to interfere with fair housing rights and prohibits sexual harassment or harassment because of race, sex, religion, national origin, familial status, or disability. In instances of harassment, the Department of Justice may pursue criminal proceedings.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Who does it protect?<\/span><\/h2>\n<p><span style=\"font-weight: 400\">The FHA must be adhered to by anyone who directly provides housing or financing to receive housing to another person. This includes landlords, real estate brokerages, lenders, homeowners insurance companies, or municipalities that grant FHA loans or public housing.<\/span><br \/>\n<span style=\"font-weight: 400\">None of the above entities can discriminate against anyone solely due to their:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">race or color<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">religion<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">sex<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">national origin<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">familial status (includes people with children, pregnant women, or families in the process of adopting a child)<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">disability<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400\">What constitutes discrimination?<\/span><\/h2>\n<p><span style=\"font-weight: 400\">Forms of discrimination include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Refusal to sell, rent, or provide financing to any of the above groups even though they qualify.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Setting different criteria in the terms, conditions, or privilege of the sale or rental of a dwelling or property loan.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Advertising the sale or rental of a dwelling indicating a preference. (e.g. Male tenants only.)<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Neglecting or delaying maintenance and repairs.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Restricting access to services and amenities available to all tenants.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Harassment, including coercing, threatening, intimidating, or interfering with a person exercising their fair housing rights.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Retaliating against a person or organization that has filed a fair housing complaint.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Sexual harassment, including quid pro quo harassment (e.g. requesting sex in lieu of rent) and creating a hostile environment (e.g. lewd comments and unwelcome groping).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">See a complete list of <\/span><a href=\"https:\/\/www.hud.gov\/program_offices\/fair_housing_equal_opp\/fair_housing_act_overview\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">discriminatory practices<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">What additional protections are in place for people with disabilities?<\/span><\/h2>\n<p><span style=\"font-weight: 400\">The FHA has more specific requirements when it comes to people with disabilities. People with disabilities include anyone with a physical impairment, intellectual disability, mental health disability, or addiction disorder (although current substance abusers are not included). In addition to disqualifying a potential buyer or tenant or denying them a loan, landlords must make certain reasonable accommodations for disabled tenants.<\/span><br \/>\n<span style=\"font-weight: 400\">Tenants are allowed to make reasonable modifications to a premises, such as grab bars in a shower, at their own expense, although the landlord can require that they remove them at the end of their tenancy. Landlords also have to make reasonable accommodations to their rules and policies for disabled people, such as allowing service animals even if they have a no pet policy.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Are LGBTQ+ people included in the FHA?<\/span><\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-48392\" src=\"https:\/\/movoto.kinsta.cloud\/wp-content\/uploads\/2020\/12\/blog-fair-housing-act2.jpg\" alt=\"Know Your Rights &amp; Understanding Fair Housing Laws - Movoto Real Estate\" width=\"600\" height=\"300\" \/><br \/>\n<span style=\"font-weight: 400\">Sexual orientation and gender identity are not protected under the Fair Housing Act, but the <\/span><a href=\"https:\/\/www.movoto.com\/foundation\/what-does-hud-mean\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">Department of Housing and Urban Development (HUD)<\/span><\/a><span style=\"font-weight: 400\"> did issue a 2012 regulation that prohibits <\/span><a href=\"https:\/\/www.movoto.com\/blog\/lgbt-housing-discrimination-exists-you-can-change-it\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">LGBTQ+<\/span><\/a><span style=\"font-weight: 400\"> discrimination in <\/span><a href=\"https:\/\/www.movoto.com\/foundation\/equal-housing-opportunity-homes-do-you-qualify\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">federal housing programs<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><br \/>\n<span style=\"font-weight: 400\">Several states have also enacted their own laws that prohibit housing discrimination against LGBTQ+ people.\u00a0<\/span><br \/>\n<b>States and territories that prohibit housing discrimination based on sexual orientation or gender identity: <\/b><span style=\"font-weight: 400\"><a href=\"https:\/\/www.movoto.com\/sitemap\/ca\/\">California<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/co\/\">Colorado<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/ct\/\">Connecticut<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/de\/\">Delaware<\/a>, the <a href=\"https:\/\/www.movoto.com\/sitemap\/dc\/\">District of Columbia<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/hi\/\">Hawaii<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/il\/\">Illinois<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/ia\/\">Iowa<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/me\/\">Maine<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/md\/\">Maryland<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/ma\/\">Massachusetts<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/mn\/\">Minnesota<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/nv\/\">Nevada<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/nj\/\">New Jersey<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/nm\/\">New Mexico<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/or\/\">Oregon<\/a>, Puerto Rico, <a href=\"https:\/\/www.movoto.com\/sitemap\/ri\/\">Rhode Island<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/ut\/\">Utah<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/vt\/\">Vermont<\/a>, and <a href=\"https:\/\/www.movoto.com\/sitemap\/wa\/\">Washington State<\/a>.\u00a0<\/span><br \/>\n<b>States that prohibit housing discrimination based on sexual orientation:\u00a0<\/b><span style=\"font-weight: 400\"><a href=\"https:\/\/www.movoto.com\/sitemap\/nh\/\">New Hampshire<\/a>, <a href=\"https:\/\/www.movoto.com\/sitemap\/ny\/\">New York<\/a>, and <a href=\"https:\/\/www.movoto.com\/sitemap\/wi\/\">Wisconsin<\/a>.<\/span><br \/>\n<span style=\"font-weight: 400\">Additionally, the city of <a href=\"https:\/\/www.movoto.com\/austin-tx\">Austin<\/a> passed a law making discrimination based on sexual orientation illegal, but <a href=\"https:\/\/www.movoto.com\/sitemap\/tx\/\">Texas<\/a> doesn\u2019t have a state law.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">Are there any other types of discrimination it doesn\u2019t protect?<\/span><\/h2>\n<p><span style=\"font-weight: 400\">Landlords are allowed to disqualify tenants based on objective criteria, such as their income, credit history, and employment status as long as they are consistent in their screening. Meanwhile, buyers, renters, and borrowers are allowed to discriminate in their property or bank searches in any way. The primary purpose of the FHA is to protect buyers\u2019 and renters\u2019 rights to equal opportunities when seeking housing.<\/span><\/p>\n<h2><span style=\"font-weight: 400\">What can I do if I believe I was discriminated against?<\/span><\/h2>\n<p><span style=\"font-weight: 400\">The Office of Fair Housing and Equal Opportunity (part of HUD) is in charge of enforcing the FHA. If you believe you have been discriminated against, you can start by contacting a local human rights agency for advice about your case. You usually begin the process by filing a complaint with HUD. You can also choose to file a lawsuit with the Department of Justice in federal court or a civil suit in state court.\u00a0<\/span><br \/>\n<span style=\"font-weight: 400\">In instances where harassment, sexual harassment, force, or threats of force occur, the Department of Justice may institute criminal proceedings.\u00a0<\/span><br \/>\n<span style=\"font-weight: 400\">Understanding your Fair Housing Act rights is important before you begin searching for a new home.
